1. Scope

These terms apply to the purchase and use of Alzyone Risk Manager & Trade Planner (the “Product”), offered on alzyonerisk.com by Maximilian Leinfelder, Alzyone (“we”, “us”).

2. Checkout and merchant of record

Payments are handled by Stripe. For purchases, Stripe (through its Link service) acts as merchant of record and reseller of the Product, and its purchase terms apply to the payment, taxes and receipt. Your card statement shows “LINK.COM* ALZYONE RISK”. These terms govern the Product itself and your use of it.

3. The Product

The Product is a downloadable Microsoft Excel workbook for planning trades, calculating position size and risk, and keeping a trading journal. It requires Microsoft Excel for Mac or Windows; the Quick Check sheet also works in the Excel app for iPhone. Microsoft Excel is a trademark of Microsoft Corporation; we are not affiliated with Microsoft.

4. Price and taxes

The price is US$9.99 plus any applicable sales tax or VAT, which is calculated and shown at checkout. Depending on your location, the checkout may show the price in your local currency.

5. Delivery

Right after payment, you are taken to a download page where you can download the Product. Please save the file. If the download doesn’t work, email us at maximilian.leinfelder@alzyonerisk.com with your receipt and we’ll send you the file.

6. License

You receive a personal, non-exclusive, non-transferable license to use the Product for your own trading. You may not resell, share, publish or redistribute the Product or modified copies of it. All rights in the Product remain with us.

7. No financial advice

The Product is a tool for education and planning. It does not provide financial, investment or trading advice, signals or recommendations. Its results depend on the numbers you enter and are estimates; for example, liquidation prices and fees may differ from your broker or exchange. Trading, especially with leverage, carries a high risk of losing money. You alone are responsible for your trading decisions.

8. Faulty files

If your file is faulty or doesn’t open, email us and we will send you a working replacement free of charge. Your statutory rights in case of defects remain unaffected.

9. Disclaimer and limitation of liability

The Product is provided “as is” and “as available”, without warranties of any kind beyond those required by law. To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential damages, or for trading losses resulting from decisions made with the help of the Product, and our total liability is limited to the amount you paid for the Product. Some jurisdictions don’t allow certain limitations of liability, so some of these limitations may not apply to you. Nothing in these terms limits liability that cannot be limited by law.

11. Governing law

These terms are governed by the laws of the State of New York, USA. If you are a consumer, this does not take away the protection of mandatory consumer laws of the country where you live.
